Fikih Pariwisata Indonesia lahir dari perpaduan antara fatwa pariwisata syariah dan paradigma Islam rahmatan lil ‘alami>n. Paradigma Islam rahmatan lil ‘alami>n sebagai perspektif kajian tidak menjadi “lawan tanding” fatwa yang diperhadapkan secara konfrontatif, melainkan sebagai penunjang atas kekurangan-kekurangan fatwa yang menjadikannya kurang utuh meyediakan sistem dalam penyelenggaraan urusan publik (pariwisata). Betapa pun fatwa merupakan bagian dari produk hukum Islam, keberadaannya tidak berarti final sehingga tidak memerlukan evaluasi bahkan kritik-konstruktif.
Fikih memandang perjalanan wisata bukan saja boleh dari segala sudut pandangnya, tetapi justru bermanfaat bagi masing-masing individu maupun kelompok masyarakat dan suatu negara yang terlibat dalam penyelenggaraannya. Jika direncanakan dan diselenggarakan dengan baik, pariwisata bermanfaat bagi pertumbuhan ekonomi suatu negara, kelestarian nilai-nilai sosial-budaya dan kearifan lokal, konservasi lingkungan, dan kesejahteraan masyarakat sekitar destinasi wisata. Berbagai manfaat tersebut bergayung-sambut dengan cita-cita ideal Islam sebagai agama rahmat bagi semesta alam.
Masuknya unsur “Indonesia” dimaksudkan agar konseptualisasi fikih pariwisata tidak kehilangan konteks ke-Indonesiaannya. Mengingat, Indonesia sebagai bangsa yang besar memiliki lanskap sosial-budaya serta kearifan lokal tersendiri yang khas dan berbeda belaka dengan negara-negara lainnya. Fikih Pariwisata Indonesia mengajukan semacam panduan keagamaan yang bersifat praksis dalam berwisata yang penyelenggaraannya tidak keluar dari koridor syariat Islam di satu sisi, dan konteks keindonesiaan di sisi yang lain.
